GENERAL TERMS

This agreement is between The Movement Catena (referred to within these terms & conditions as “TMC”) and anyone who subscribes, buys, enrols or attends any of TMC’s products or services. By subscribing, buying, enrolling or attending any of TMC’s products or services, you agree to be bound by the terms and conditions below as well as for any future purchases.

Account Information
It is your responsibility to maintain up-to-date contact details with TMC and to check your emails including ‘spam/junk’ mail to ensure you receive all information necessary from TMC, as well as to check our website and social media pages for important updates.
PRODUCTS: returns, exchange and REFUNDs POLICY

PRELOVED ITEMS
TMC sells previously owned goods, and these items are sold “as is” and labelled as "pre-loved". Please keep in mind that the expected level of quality and performance might be lower for second hand goods, depending on factors such as age and wear. This is why we price at a great discount. We take great care to ensure we resell quality items, but as these are classified as second-hand goods under Australian Consumer Law, returns are not accepted and refunds or exchanges are not given. We highly recommend you come into the studio to try on and to visually inspect before deciding to make a purchase, as we do not cater for you changing your mind.

Returns are accepted for items that are broken, defective, or if evident that the item does not match the description provided.

SERVICES: REFUND POLICY (CLASSES, PROGRAMS, WORKSHOPS, EVENTS ETC)
All TMC services are NON-REFUNDABLE. Please see ‘Cancellations & Refunds’ section for details on how to cancel your membership and if you are eligible.
PAYMENTS
​
General Terms
-
All services provided by TMC must be paid in advance. Any outstanding amounts in your account must be paid before you can attend classes or any of our services with TMC, which include but are not limited to: studio hire, group classes, private classes, bootcamps, workshops, performance courses and extra-rehearsals.

If you have attended any of our classes, events, workshops etc, your credit card/bank account may be charged automatically. We have the right to charge your credit card at regular intervals until full payment is received. Any declined payments will incur additional fees
-
If you are on a 6 monthly payment contract, your membership fee will be charged in advance each month.
-
We will debit your membership fee from your nominated account or credit card on the same day every month.
-
If you prefer to pay your membership fee in advance, you can make a full upfront payment in cash, at a discounted rate.
-
Your debits will appear as “Ezidebit Healthfit MB” on your credit card or bank statements.
-
If debit dates fall on a public holiday, we will debit your nominated account or credit card on the next business day. Debits might take up to 5 days to come out of your account.

It is your responsibility to make sure your account has enough funds for us to charge your membership fees on a monthly basis.
-
It is your responsibility to tell us if you are transferring or closing your account, at least 48 hours before your next direct debit.

It is your responsibility to tell us about any changes to your credit card details, at least 48 hours before your next direct debit.
-
TMC reserves the right to charge for any classes attended which you have not paid for at reception prior.
-
You must provide us with a valid credit card for the duration of your contract with TMC, including updating if the card has expired or is no longer valid. Failure to provide an updated credit card immediately upon request may result in termination of your contract with all future memberships being paid upfront only.

TMC credit remains active for 3 years after which expires and is unavailable for use.
What happens if your direct debit fails?
In the event of a declined payment, your account will be immediately suspended, pending the payment being received by TMC in full.
We will continue to debit your nominated account without notice, until we have received the total amount you owe us.  Should we continue to be unable to collect payment from your nominated bank account or credit card, we will contact you and ask you to nominate an alternative bank account or credit card for recurring payments.

A dishonour fee of $25 will be charged for each declined payment. Any ongoing unpaid balance for membership dues or fees, goods or services will result in automatic suspension of membership privileges and you agree to pay all costs of collection, including but not limited to collection agency fees, court costs, administrative costs, disbursements and lawyer fees which may be paid or incurred by TMC.
It is your responsibility to ensure you update TMC with your nominated bank account or credit card information, should it differ from what you originally provided. It is your responsibility to ensure you have sufficient funds in your nominated bank account so that payments do not fail and your contract/membership fees are paid in full.

Can I try your classes before starting a membership?
Yes! We offer various trials which you can find under our ‘PRICING’ section. Each trial is for new students ONLY and can only be claimed ONCE per person. There are no obligations after your trial, and if you would like to continue with classes after your trial, we can help direct you to the best option.
ACTIVATION
Can I change the activation date of my Gold, Silver, Bronze, Trial or Online Membership, 8 Class Pass, Drop-In Class or Monthly Paid Pass?
Yes, as long as the activation date is set within six months of the membership’s purchase and the current activation date has not passed. If you purchase a new membership whilst you have one active, the new membership’s activation date must be set within three months of the current membership’s expiration date or within six months of the purchase date, whichever date is greater.
CANCELLATIONS & REFUNDS
Any changes to your membership will incur a $50 administration fee.
Can I have a refund?
No. All TMC services are NON-REFUNDABLE.
Can I transfer my contract/membership?
Yes. The 6 month contract memberships can be transferred, subject to approval and a $25 admin fee will apply. No other class passes or memberships can be transferred.

Can I cancel my contract/membership?
No. You may transfer your 6 month contract for the remaining period only. No other class passes or memberships can be cancelled or transferred. Contractual transfer is required to be completed in writing via TMC forms.
If you paid for your membership upfront in full, you will be required to organise a pay out of the contract to yourself, from the person whom you have sourced to take over your contract.
If you have completed the full term of your first membership and you are on a month by month auto-renewal basis, the cancellation of your membership will be effective 30 days from the day of your last scheduled payment.
Can I cancel my 3 class pass, 5 class pass, 10 class pass, 20 class pass, or one-month unlimited (no contract) pass?

No. Any payment option that is NOT the 6 month unlimited contract/ membership, is non-refundable after 24 hours from purchase. If you wish to cancel your 3 class pass, 5 class pass, 10 class pass, 20 class pass, or one-month unlimited (no contract) pass within 24 hours of purchase, you will incur a $50 administration fee.
How can I cancel my 1 month unlimited (no contract) recurring payments?

Simply send an email to hello@themovementcatena.com, allowing at least 3 business days to process. You must ensure any outstanding balance is paid before the cancelation can be activated. All communication regarding changes to your membership must be done in writing. The cancellation of your payments will be effective 30 days from the day of your last scheduled payment.
Once your membership has been cancelled, it cannot be reinstated and you must purchase a new membership at your own cost.
Can I change my activation date?

Yes, you can request an activation date change only before the original date has passed. Once the date has passed, it will not be able to be changed.
Refunds and credits can only be done for the person who made the purchase. We do not refund or credit a person of a different name or account.
Can TMC cancel my membership?
​
We reserve the right to cancel your membership should your direct debit payments continue to bounce and no alternative method of payment is provided in a timely manner or may you refuse to abide by administrative requirements. In the event that you had your membership cancelled by TMC and you may wish to use any of TMC’s services, classes or memberships in the future, you will be requested to pay any outstanding debt from previous services. TMC may refuse direct debit payment options and request upfront payment.
Bootcamps, Workshops, Events
We do not offer refunds for pre-paid bootcamps, workshops and events
SUSPENSION TIME:

Can I suspend or pause my contract/membership?
​
Yes, the 6 month contract/memberships can be suspended in 30 day increments ONLY and only ONE 30 day suspension is allowed per 6 month contract.
​
Can I suspend my membership for just a week or so?
No.
Can I pause or extend my 3 class pass, 5 class pass, 10 class pass, 20 class pass, or one-month unlimited (no contract) pass?
No. Any non-membership payment option cannot be paused, suspended or extended.
How do I suspend my membership?
​
Membership suspension requests (for 6 month contracts) must be done in writing via email to hello@themovementcatena.com allowing at least 3 business days to process. Any outstanding fees must be paid prior to suspensions being approved.
Suspensions cannot be backdated.
Once your suspension has begun, it cannot be unsuspended. If you wish to attend classes during your suspension time, you can do so by paying for a drop-in or other pass option.
MEDICAL SUSPENSIONS
Medical Suspensions can be provided when supplied with a medical certificate, from the dates the certificate specifies.
The Medical Suspension is valid for a maximum of half the total membership time, or half the total redeemable time period of the pass.
E.g. the maximum medical suspension for a 6 month Membership is 3 months.
E.g. maximum medical suspension of an 8 class pass is a 1 month medical suspension.
These suspensions must be requested in writing via email, cannot be backdated, and cannot be unsuspended in the same way as other suspensions.
In addition, a medical certificate must be provided for it to be approved.
Please ensure you allow administration 3 days to approve your medical suspension before it can be applied to your account.

ONE MONTH UNLIMITED

SIX MONTH UNLIMITED

Must be activated within six months of purchase/redemption unless otherwise stated.

Cannot be refunded but can be transferred

Can be suspended for a total of one x 30 day increment

Gives six (6) months of unlimited regular classes only – special classes, courses, workshops, bootcamps and events are non-inclusive.

Activates from first class booked in.

Lasts for 6x 30 consecutive days (or a 6 month period).

SHORT COURSES, WORKSHOPS, BOOTCAMPS, events

These are set to run on specific dates as outlined upon purchase.

Tickets can only be purchased via Trybooking.com and all Trybooking terms & conditions apply to any purchase.
-
These short courses, workshops or bootcamps cannot be refunded or credited unless TMC cancels the course.
-
All attendees must purchase for the entire course in advance, regardless of how many sessions will be attended. No discounts or refunds will be given for your inability to attend all sessions or the entirety of the course, workshop or bootcamp.

Instructors and teaching format is subject to change.

Tickets cannot be exchanged between students, and are one ticket per person for the entire course
PROMOTIONS
-
TMC reserves the right to cease any promotion at any point without prior notice.
-
Promotions must be redeemed in accordance with their written instructions.
-
Promotions expire at a maximum of 3 months of their offer unless otherwise stated.
-
Promotions may only be redeemed once and cannot be used in conjunction with other promotions.
-
If promotion is a discount, the promotion can only be used to discount full-priced TMC service or product unless the promotion specifically states in writing that it can be used towards a discounted TMC service or product.

Promotions cannot be exchanged or refunded for their cash or credit value.

All TMC products or services redeemed are applicable to the standard TMC terms and conditions.

By participating/redeeming a promotion, you agree to all TMC terms and conditions.

How to redeem your Gift Certificate
​
1) Online: Head to www.themovementcatena.com and choose what you want to purchase. During payment, select the ‘Redeem a gift card’ option and enter your unique gift card code. If the price of the sale is worth more than the value of the card, you can pay for the remaining cost using your regular payment methods.
2) In Stores: Print a copy of the gift card and present it at the counter or display the gift card on any mobile device.
Terms Of Use

The gift certificate is non-transferable and can only be redeemed for services and products offered by The Movement Catena (TMC). The certificate's value may be used towards regular timetabled classes and merchandise only. Special classes, courses, workshops, bootcamps, intensives and events are all non-inclusive

The certificate is valid for a period of 36-months (3 years) from the date of purchase, beyond which it will be considered null and void. No extensions or refunds will be provided for expired certificates.

The value of the gift certificate is as stated at the time of purchase and is in Australian Dollars (AUD).
-
The certificate must be presented at the time of redemption. It cannot be redeemed for cash, used to buy another gift certificate, replaced if lost, stolen, or damaged, and is not refundable.

TMC is not responsible for any unauthorised use, loss, or theft of the gift certificate.
-
In the event that the total purchase exceeds the value of the gift certificate, the recipient must pay the remaining balance at the time of redemption.
-
Gift certificates cannot be combined with other promotions, discounts, or offers unless explicitly stated.
-
Loyalty rewards and coupon codes cannot be redeemed to purchase part/all of a gift certificate.

TMC reserves the right to alter or amend these terms and conditions at any time without prior notice. Any changes will be effective from the date of posting on the TMC website or communicated through other means.

By purchasing, accepting, or using the gift certificate, the recipient agrees to abide by these terms and conditions.
PUBLIC HOLIDAYS & ANNUAL BREAKS
Cancellation of classes
TMC reserves the right to cancel classes due to unforeseen circumstances, on public holidays, over the period of large events and 2 weeks over the end of the year break. We will make a reasonable effort to inform cancellation of classes in advance via email, our social media channels, notice boards at reception and during classes. These cancellations will not change the terms of your membership.
OUR FEES

Can we increase your fees?
​
Our fees are displayed on the website. In case of discrepancy of fees displayed on the website and reception, the fees advertised on the website must be considered the correct ones. We reserve the right to increase our fees at any time without notice. We will make a reasonable effort to inform you and all students of any increase of fees in advance via email. If we don’t hear from you, we will consider that you have agreed with the new fees. Any fee increase will only affect you after the expiry date of your current membership or if you sign-up for a new contract.
PRIVATE CLASSES

Prices are inclusive of GST and studio hire at TMC premises.

Bookings can only be confirmed upon full payment.
-
Private classes are non-refundable but can be credited and used towards other TMC services upon approval.
-
All packages and group privates must be paid upfront and in a single transaction.
-
Cancellations with 48hrs notice: class can be re-scheduled at no cost.
-
Cancellations with less than 48hrs notice or no show are not refundable and will need to be rescheduled for an additional cost.
-
Your private class must be activated within 6 months of purchase.
STUDIO CODE

Respecting our facilities
You are responsible for using our facilities with care. Note that you will be responsible for any damage that you or your guests cause through a wilful act or negligence. Any children brought onto the premises must be supervised at all times.
Keeping your belongings safe
Please keep your belongings safe and do not bring valuables into the studio. We cannot accept responsibility for any loss or damage to your belongings while you are at the studio. We hold on to lost property for only a brief period and then give items to charity, so please contact TMC via email immediately if you have lost property so that if found, we can do our best to return to you. Please be aware that any items left on the premises are not the responsibility of TMC or staff.
Parking
We are not liable for any loss or damage to your vehicle or its contents even if you are parked within the studio’s car park, the building premises or nearby areas. Please don’t park in our neighbours’ car spaces as this may incur in a fine issued to us and will then be charged to you.

Refusal of Entry
We hold the right to refuse entry to anyone, or to request you to leave the premises at any time. If required, TMC Directors will discuss appropriate action including but not limited to, termination or suspension of memberships, refusing participation in classes and courses, refusing studio hires or attending any TMC events. We can refuse your attendance without warning if you behave in a way that is risky or seriously inappropriate, such as:

Refusal to pay for any activity prior to attending.

Threatening, bullying or harassing others.
-
Disruptive behaviour making staff and/or other students uncomfortable and having a negative impact on student learning
-
Damaging premises or studio belongings.
-
Theft
-
Refusing to cooperate with instructors or staff’s instructions and/or not abiding by the studios policies, procedures or code of conduct.
-
Instructing other members within classes when we have not authorised you to do so.
-
Severely poor hygiene, affecting other students desire to participate
-
Defamatory behaviour, character assassination, gossiping saboteurs or anyone with the deliberate intention of sabotaging the success of TMC, TMC Directors or other staff.
Close contact
You understand that certain classes and choreographies require physical contact and close proximity with dance partners including holding of hands, leading the partner with physical cues, lifts or other moves. We expect all participants to behave in a safe and appropriate manner at all times. If you are uncomfortable with participating, you must contact TMC management immediately so that we can guide you in finding a more suitable class for you. It is your responsibility to not do anything you are not comfortable with.
Attending classes
Numbers are restricted, and classes are filled on a first come first served basis. TMC is not responsible for any missed opportunities to attend classes, choreography courses etc, should there be no more places available at the time of booking.
Timetable & Scheduled Instructors
We reserve the right to add, change or remove classes and instructors on our regular class timetables, other courses, workshops or bootcamps without notice. The most up-to-date timetable will be available at our website, however last-minute changes of instructors can occur due to unforeseen circumstances.
Your health 
In attending our classes, events, courses, workshops, bootcamps or other programs, we trust that you are in good health and that you know of no medical or other reason why you cannot or should not engage in active or passive exercise. Our staff and contractors are not medically trained or qualified to assess if you are in good physical condition and can exercise without risking your health, safety or comfort. If you have any doubts, we strongly urge you to seek expert advice before starting classes with us.

By attending our classes, events, courses, workshops, bootcamps or other programs, and using our premises, facilities and equipment you acknowledge that there are certain inherent risks and dangers associated and that injury may result from your participation with TMC classes, and you voluntarily assume the risks associated with such participation.
​
In consideration of being allowed to participate in and access the classes and facilities, you hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to the classes and facilities, (2) release, indemnify, and hold harmless TMC its direct and indirect parent, subsidiary affiliate entities, and each of their respective officers, directors, members, employees, contractors, representatives and agents, and each of their respective successors and assigns and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the classes or use of the facilities, and (3) represent that you (a) have no medical or physical condition that would prevent you from properly using TMC classes and facilities, (b) do not have a physical or mental condition that would put you in any physical or medical danger, and (c) have not been instructed by a physician to not participate in physical exercise. You acknowledge that if you have any chronic disabilities or conditions, that would knowingly put you at risk in using TMC classes and facilities, that you should not be participating in any classes

You agree to comply with all rules imposed by TMC regarding the use of the facilities and equipment. You agree to conduct yourself in a controlled and reasonable manner at all times according to the safety and general operating protocols clearly outlined by TMC. You also agree to refrain from using any equipment in a manner inconsistent with its intended design and purpose.
Age Restrictions

Most of TMC services, including but not limited to classes, bootcamps, workshops, programs and short courses, etc are designed for adults over the age of 18.

Anyone under the age of 18 wanting to attend any of the adult classes or services, must seek prior approval from TMC and if approved by TMC, written consent must be given by the parent before commencing

TMC may at times schedule children-specific classes. Adult students cannot attend these classes. To purchase from the TMC online system, you must be over eighteen years of age. As such, parents must apply for their childrens enrolment and by doing so are consenting to their childrens attendance at TMC.
STAFF CODE OF CONDUCT

TMC staff will maintain a professional relationship with all students and clients of TMC and prioritise providing professional service and care throughout their employment.

Staff will always strive to provide excellent customer service to all clients and ensure a professional and understanding attitude with calm and clear communication.

Instructors and staff will be punctual and respectful of student’s time and aim to keep classes running on schedule.
-
Instructors and staff will be aware of safety in the studio, monitor student behaviour, and inform the director of any incidents witnessed as soon as reasonably possible.
-
All staff when opening/closing the studio will act responsibly with the handling of monies, keys, and all TMC property and ensure the facilities and premises are protected.
-
TMC has zero tolerance for the use or presence of illicit substances within the premises or at any associated events, whilst working for or representing the studio.
-
Staff will always remain professional in the presence of alcohol or at parties and events.
-
Staff will abide by TMC privacy policy regarding student’s and staff’s personal and private information at all times, both inside and outside the studio.
Claiming against outside providers
Contractors and tenants provide some services in our studio, such as private classes, workshops, events etc. You will need to pay service fees directly to them and we are not responsible for those fees or for any associated costs or refunds.
Any service they provide is a contract between them and you and we cannot accept any responsibility for a breach of contract or negligence. If you make a claim because of something a contractor or tenant has or has not done, your claim should be brought against the provider, not us, whether you have paid them or not. You release us from any claim resulting from an act or omission by a contractor or tenant.

Change of location
We can change the location of the studio at anytime. We will give you 7 days notice in writing via email.
Change of business name
We reserve the right to change our branding and business name at any time. This may occur in case we enter a partnership or merge with another institution or just feel the need for a new brand identiy/ fresh image. We may send you a written notice via email outlining the details of any changes.
Which laws apply?
Meeting state laws Your agreement is subject to Australian law and is governed by the NSW state laws where your studio is located. If a court decides that any section of your agreement is invalid or unenforceable, that section will be deleted from the agreement. The other sections will remain valid and enforceable.
Restricting your rights to sue
Under the Competition and Consumer Act 2010, we guarantee that our services are:

provided with due care and skill.

fit for any purpose you have told us you are using the services for or for a result which you have told us you wish to achieve.

supplied within a reasonable time.
However, under certain legislative provisions, we may ask you to agree that these conditions do not apply to you. If you accept the agreement, you will be agreeing that your rights to sue us are excluded, restricted or modified as set out in these terms and conditions. This applies if you are injured (including injury that results in death) because the services were not rendered with due care and skill, or they were not reasonably fit for their purpose.
